SAN FRANCISCO — A district court judge sentenced two men to prison over their actions in a 2018 drug deal that ended in an injury shooting, the U.S. Justice Department said.

According to separate plea agreements this July, Stockton men Khari Moore, 23, and Malik Lott, 25, talked to a person through Craigslist who agreed to sell them marijuana, chatting by text to finalize an in-person meeting April 8, 2018, where they joined other people in driving to Redwood City. There, Moore and Lott hoped to buy four pounds of marijuana before later reselling it for a profit.

According to charging documents and court records, the men met outside a BevMo liquor store and agreed to a $4,000 price tag after examining the marijuana. Both buyers and sellers said they would leave the parking lot to get the pot and the money, respectively.

The sellers left the area, got the marijuana, and returned, but Lott and Moore never left. Prosecutors said Moore brandished a gun while Lott tried to grab the marijuana, with Moore opening fire as the dealers tried to drive away, and hitting the pickup truck’s driver in the hands and face several times. Moore and Lott then fled back to Stockton without the marijuana.

After an investigation by Redwood City police and the Bureau of Alcohol, Tobacco, Firearms and Explosives, Lott was charged last October with conspiracy, as well as drug trafficking, robbery and conspiracy to commit robbery.

After pleading guilty in July to a lone charge of conspiracy to distribute and possess with intent to distribute marijuana, authorities dropped the other charges. Moore also pleaded guilty later in July to conspiracy, as well as a count of brandishing a firearm during drug trafficking.

According to prior reporting by this news organization, both men had faced up to 20 years in jail if convicted on the robbery charges alone.

Moore and Lott will begin serving prison terms of 87 months and 12 months and a day, respectively, as well as five- and three-year supervised release terms, with Moore ordered to pay restitution.
